Dr. Thomas Eller, primary adjunct professor for the Advanced Pricing and Cost Analysis course in the Procurement and Contract Management Certificate Program, University of Virginia, joins the Chapter to talk about defective pricing.
Program Description
Working with the US Government Department of Defense supporting our National Security often times requires a contractor to submit an adequate proposal that contains elemental cost data. This exchange of information between the contractor and US Government is necessary to arrive at a fair and reasonable price. Unfortunately, there are instances when “all” cost data is not revealed that can lead to a defective pricing case.
Attendees will learn what constitutes an adequate proposal, the cost elements, the applicable cost accounting standards and what the Truth in Negotiations Act means. We will have a robust discussion on why it is important to assure all information is divulged at proposal submittal and subsequent changes that occur throughout negotiations. Lastly, we will discuss what happens if a defective pricing case is initiated and each party’s responsibility.

Dr. Thomas Eller
Adjunct professor, Procurement and Contract Management Certificate Program

Dr. Eller is the primary adjunct professor for the Advanced Pricing and Cost Analysis course in the Procurement and Contract Management Certificate Program, University of Virginia, since 2018.
Dr. Eller has over 35 years of Active Duty and Civil Service experience with the United States Air Force. Dr. Eller has served as a contract specialist, procurement contracting officer with an unlimited warrant, branch chief, and division chief. His other experience includes roles as Competition Advocate, Ombudsman, Technical Director, and Policy and Pricing Chief. His technical experience includes fixed and cost price contracts, commercial and noncommercial, source selections (LPTA to Color-Coded), incentive contracting, letter contracts, and foreign military sales contracting.
Dr. Eller completed his Doctor of Business Administration degree in June 2014 through Walden University culminating in a qualitative phenomenological study exploring the effects of humor and fun in the workplace on employee morale and well-being when used by organizational leaders, managers, and employees. Dr Eller has a Level III DAWIA Certification in Contract Management and Level I DAWIA certification in Program Management.
Dr Eller is a graduate of the Air Force Air Command and Staff College and Air War College; the University of North Carolina Kenan-Flagler Executive Development courses Enterprise Leadership Seminar; Understanding the Defense Industry; and the National and International Leadership Seminar.
Dr. Eller is an active member of the Middle Georgia NCMA Chapter as the Senior Leader mentor, member of the National Leadership Society, and lifetime member of the NCOA.
